Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs your use of the TextPros SMS messaging platform ("Service"). This AUP is part of our Terms of Service and applies to all users of the Service. Violations of this policy may result in immediate account suspension or termination.
1. General Principles
TextPros provides SMS and MMS messaging tools for legitimate business communication. You are responsible for ensuring that all messages sent through the Service comply with this policy, all applicable laws, carrier requirements, and industry standards. Ignorance of these requirements is not a defense against violations.
2. Consent Requirements
Every message you send through the Service must be directed to a recipient who has provided appropriate consent:
- Promotional and marketing messages require prior express written consent from the recipient, as defined under the Telephone Consumer Protection Act (TCPA). Written consent must clearly disclose the type of messages to be sent, the identity of the sender, and that consent is not a condition of purchase.
- Transactional and informational messages (order confirmations, appointment reminders, account alerts) require prior express consent, which may be verbal or written.
- Consent must be documented. You must maintain records of when and how each recipient provided consent and be able to produce these records upon request.
- Purchased or rented contact lists are prohibited. You may not send messages to phone numbers obtained from third-party list brokers, data resellers, or lead aggregators unless you can demonstrate that each recipient provided consent directly to your business for the specific type of messaging you intend to send.
3. Opt-Out Compliance
You must honor all opt-out requests promptly and completely:
- The Service automatically processes STOP keyword replies and removes recipients from active messaging. You must not interfere with, disable, or circumvent this functionality.
- When a recipient replies with STOP, UNSUBSCRIBE, CANCEL, END, or QUIT, messaging to that number must cease immediately.
- You must not re-add opted-out recipients without obtaining new, verifiable consent.
- You must not send messages that discourage or make it difficult for recipients to opt out.
- Each message must include clear opt-out instructions (e.g., "Reply STOP to unsubscribe") unless it is a direct response to an inbound message from the recipient.
4. Prohibited Content
The following types of content are strictly prohibited on the Service. This list is not exhaustive; we reserve the right to determine what constitutes a violation.
4.1 Spam and Unsolicited Messages
Sending bulk or individual messages to recipients who have not consented to receive them. This includes cold outreach to numbers scraped from websites, directories, or social media.
4.2 Fraud, Phishing, and Deception
- Messages designed to deceive recipients into revealing personal information, passwords, or financial data
- Impersonation of another person, business, government agency, or organization
- Messages containing false or misleading claims about products, services, or offers
- Social engineering attacks of any kind
4.3 Illegal Content and Activities
- Content that violates any federal, state, or local law
- Promotion of controlled substances, illegal drugs, or drug paraphernalia
- Promotion of illegal gambling or unlicensed financial services
- Content related to the exploitation of minors
- Promotion of weapons, ammunition, or explosives in violation of applicable law
4.4 Harassment and Harmful Content
- Threats, intimidation, or harassment directed at any individual
- Hate speech targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Content intended to bully, stalk, or cause emotional distress
4.5 Restricted Industries
Certain industries are subject to heightened scrutiny by carriers and regulators. The following categories require prior approval from TextPros before sending messages, and may be subject to additional compliance requirements:
- Cannabis and CBD (where legal)
- Firearms and ammunition
- Alcohol and tobacco
- Lending, debt collection, and financial services
- Political campaigns and advocacy
- Age-restricted content

5. 10DLC Compliance
All users sending messages to U.S. phone numbers must comply with 10DLC (10-Digit Long Code) requirements:
- Brand Registration — You must register your business (brand) with The Campaign Registry (TCR) through our platform. Registration requires accurate business details including legal name, EIN/tax ID, and business address.
- Campaign Registration — Each distinct messaging use case must be registered as a separate campaign with an accurate description of the message content and purpose.
- Throughput Limits — Your messaging throughput (messages per second) is determined by your brand trust score and campaign type. You must not attempt to exceed your assigned throughput limits.
- Content Consistency — Messages sent through a registered campaign must match the declared use case. Sending messages that do not match your campaign registration may result in carrier filtering and account penalties.
- Registration Accuracy — Providing false or misleading information during brand or campaign registration is grounds for immediate account termination.
6. Message Rate Limits and Sending Practices
- You must respect the rate limits assigned to your account and phone numbers. These limits are determined by your 10DLC trust score, phone number type, and carrier policies.
- You must not use multiple accounts to circumvent rate limits or sending restrictions.
- You must not programmatically rotate through phone numbers to evade carrier filtering ("snowshoeing").
- Messages should be sent during reasonable hours (generally 8:00 AM to 9:00 PM in the recipient's local time zone) unless the messages are time-sensitive transactional notifications.
- You must include your business name or a recognizable identifier in your messages so recipients can identify the sender.
7. Technical Abuse
The following technical behaviors are prohibited:
- Attempting to access the Service's infrastructure, APIs, or databases without authorization
- Using automated tools to probe for vulnerabilities, exploit security flaws, or conduct denial-of-service attacks
- Reverse-engineering, decompiling, or disassembling any part of the Service
- Sharing API keys, access tokens, or account credentials with unauthorized third parties
- Using the Service to relay messages for third parties who have not independently agreed to these Terms
8. Monitoring and Enforcement
We actively monitor messaging patterns, complaint rates, and carrier feedback to detect violations of this policy. Our monitoring practices include but are not limited to:
- Automated analysis of messaging volume, opt-out rates, and carrier complaint signals
- Review of flagged content in response to carrier or recipient complaints
- Periodic audits of campaign registrations and messaging practices
9. Consequences of Violations
Violations of this AUP may result in one or more of the following actions, at our sole discretion:
- Warning — A written notice requiring you to correct the violation within a specified timeframe.
- Throttling — Temporary reduction of your messaging throughput.
- Suspension — Temporary suspension of your ability to send messages while the violation is investigated.
- Termination — Permanent closure of your account. Unused credits are forfeited upon termination for policy violations.
- Reporting — We may report illegal activity to law enforcement or relevant regulatory authorities.
Severe violations, including phishing, fraud, or illegal content, may result in immediate termination without prior warning. We are not obligated to provide refunds for accounts terminated due to policy violations.
10. Reporting Violations
If you become aware of any misuse of the Service or suspect that another user is violating this policy, please report it to support@textpros.io. We take all reports seriously and will investigate promptly.
11. Changes to This Policy
We may update this AUP from time to time to reflect changes in regulations, carrier requirements, or industry best practices. When we make material changes, we will notify you at least 30 days in advance. Your continued use of the Service after the effective date constitutes acceptance of the revised policy.
